remains, how did this happen in the first play? the coast guard will be meeting with the pilot in a few hours. according to the "mercury news," state records show in 2009 the pilot ran aground a 550 cargo ship in sacramento. he also crashed a 600-foot cargo ship into a catwalk in stockton. and two years ago, he was at fault when a tugboat ran aground in the richmond inner harbor. now, back out live you can see that boat right here. we do know we want to make note that that pilot did test negative for alcohol. the coast guard says preliminary findings show it was probably human error. i understand that this investigation is expected to take several days so it will be a while before we have a cause of the crash. cate caugiran, cbs 5. new this morning a gas station clerk in antioch depends off several robbers. this happened at a shell station at lone tree way and country hills drive.

the clerk says three men came in and attacked him. he says he fought them off singlehandedly although they got away with a few cases of beer. we have a crew heading to the scene and will bring you an update shortly. also new this morning a federal court has dismissed a lawsuit stemming from a beating outside dodger stadium in los angeles. the plaintiff giovanni ramirez was arrested for the 2011 attack on bryan stow a silicon valley paramedic. ramirez was released and now two other men were charged. ramirez has sued the l.a. police department claiming his rights to due process were violated. a man suspected of setting his girlfriend on fire in san francisco is now under arrest this morning. we are told 22-year-old dexter oliver will be charged with attempted murder and arson for sunday's attack in the bayview at a laundromat. police arrested him at an oakland hotel. the victim 25-year-old star lamar still hospitalized with life-threatening burns. a basically accused of

hitting -- bicyclist accused of hitting and killing someone is charged with felony vehicular manslaughter for last april's accident. today's court appearance is set for a preliminary hearing. the man charged with killing two people in san francisco on new year's day goes to court this morning. 19-year-old david morales is facing two counts of murder and a number o other charges arrested after a shooting and crash that left two people dead on south van ness avenue. his bail is $10 million. dna technology has promised and arrest in a -- prompted an arrest in a 1985 mountain view murder. the body of 21-year-old saba germai was found on north shore

line boulevard. friday 53-year-old daniel garcia of fresno was arrested for suspicion of murder. his dna was found under the victim's fingernails. walnut creek police are defending two officers who shot and killed a 22-year-old man last month. police say anthony banta had a 10" knife in his hand when officers responded to the diablo point apartments. according to the police chief, the officers ordered banta to drop the knife several times. then banta charged toward the officers with the knife in his hand. >> officers don't shoot and kill anyone. they don't shoot anyone unless they're absolutely forced to do that and in this particular case, they were. >> the chief says toxicology reports are pending. banta had no criminal record. the officers are on full duty. state superintendent of public instruction is expected to unveil a any system today for standardized testing in california schools. last year, the state legislature gave tom torlickson

the task of revamping student achievement tests which gauge progress in english, arts and math. new testing is expected to include critical thinking and problem solving skills to comply with the new national guidelines known as common core. >> and getting a bit of a makeover. should be a nice day but the fog is thing in the east bay valleys visibilities down to a quart mile and there's a dense fog advisory up there this morning in through concord, livermore. watch out, we have thick fog early on today. and it's going to take some time to break up. once it does, we should be looking at hazy sunshine and speaking of hazy, that's what it is over the bay right now. no fog there. the temperatures really not all that bad. 41 degrees in concord but we have some fog, 37 degrees in santa rosa, 44 in san jose, and 47 degrees in san francisco. i think by the afternoon, we are going to enjoy some sunshine and the high pressure holding on for at least one last day now. eventually this ridge breaks down so tomorrow big changes could even see a few showers

return to the bay area and much colder temperatures on the way. highs today in the 50s and 60s and the next few days we could be talking about a little snow. we'll have more on that in a few minutes. no major hot spots on the roads. here's a live look outside. this is near 880 and 66. we are close to the oakland coliseum, oakland airport, as well. so yeah, no major delays on northbound or southbound both directions free and clear between hayward and downtown. to our maps, lawrence mentioned it some of the fog in the east bay and chp issued a dense fog advisory for stretches of highway 4 in particular, antioch, pittsburg, conditions are pretty slow in the area already. and you can actually see roadwork in lanes as well on eastbound highway 4 through the antioch area. elsewhere here's a live look across the golden gate bridge. did some lane changes a little while ago so now everything is free and clear heading into san francisco. 880 and 237, no delays.

the altamont pass still at top speeds from the altamont pass through livermore towards the dublin interchange. bart so far all trains are on time. that is traffic. back to you guys. >> thank you. some bay area headlines. a teenaged boy is oakland's first homicide victim of 2013. he was found shot to death in a parked car near hegenberger road and hamilton street yesterday afternoon. so far no arrests and no word on a motive the man accused of killing seven people at oikos university last year is back to court january 28. a judge ruled yesterday that the 44-year-old one goh is not mentally fit for trial. he may be sent to napa state hospital for treatment after discussions resume a little later this month a plan ran out of runway in -- a plane ran out of runway in san carlos and ended up nose down in a pond stuck in the mud. no injuries but the plane did have some damage. a sheriff's deputy says the pilot may have been going too

fast when he tried to land. the incident closed the airport for six hours. an suv smashed into a livermore restaurant while customers were inside eating lunch. police say the driver of a parked cadillac escalade hit the wrong pedal and crashed into the strings italian cafe yesterday. the suv plowed into the dining room and out the other side of the building. one person suffered a broken leg. hundreds of thousands of people would get money under a settlement for wrongful foreclosures. the banks agreed to pay $8.5 billion to settle complaints that they mishandled paperwork and skipped required steps in the foreclosure process. depending on the errors, affected homeowners could get up to $125,000 in compensation. this morning we know when the u.s. supreme court is going to take up the prop 8 case. oral arguments will begin on march 26. at issue whether it was constitutional for california voters to ban gay marriage through the 2008 ballot

measure. the next day the court will hear arguments on the constitutionality of the federal "defense of marriage act." the rulings are expected sometime in june. president obama says it's in the nation's interests for congress to promptly confirm his nominees for defense secretary and cia director but as susan mcginnis reports, get ready for another battle on capitol hill. reporter: president obama announced his picks for the next heads of the pentagon and the cia. now they need congressional approval before they can get to work. >> we need to get moving quickly on this. >> reporter: senator chuck hagel is the nominee for secretary of defense. a former enlisted man and vietnam vet, the president says hagel can relate personally to america's troops. >> to this day, chuck bears the scars and the shrapnel from battles he fought in our name. >> reporter: but winning confirmation won't be easy. some of hagel's former senate colleagues call him hostile toward israel and soft on iran. >> i'm waiting for an

we have been on the air at 4:30. not much fog on the bay bridge. this is westbound 92 towards the high-rise. let's go to our maps. chp has advised us that visibility is low across stretches of highway 4 this morning from antioch all the way towards the pittsburg-bay point area and actually we're already seeing some slowing on the sensors. the eastbound lanes of 4 there is roadwork. also roadwork in lanes southbound 101 between poplar and highway 92. only the right lane is getting by until 6 a.m. we'll let you know if they wrap up that ahead of schedule. often they do. here's a live look across the golden gate bridge. no problems. earlier they had some roadwork, only one northern lane open overnight but more lanes have opened now so now,' looking good in both directions -- so now you're looking good in both directions. 880/237 quiet. westbound 580 a few brake lights now just in the last few

tahoe, 46 in yosemite and 57 in fresno. around the bay area temperatures fairly mild. 63 degrees today and sunny in san jose. 60 in fremont. should be about 62 in palo alto and 60 degrees in half moon bay. east bay temperatures running up into the 50s and also the 60s after we had some dense fog this morning and inside the bay hazy sunshine 61 degrees very comfortable into oklahoma and 58 in san francisco. next couple of days big changes in the works. some clouds roll in. there's a chance we could see some showers as early as tomorrow. and definitely some cooler temperatures. much colder air moves in on thursday and friday, the snow level is going to drop down to about 2,000 feet. there's not going to be much moisture but if we do get some rain it will turn into snow across the higher mountain peaks. cool weather this weekend. 5:17 now. a toddler down in southern california dies after eating chili powder and now a young woman is under arrest. it happened in apple valley just north of san bernardino. sheriff's deputies went to a

home sunday and found a 2-year- old girl having a seizure. she died at the hospital. an autopsy is planned to find out what role that chili powder played in her death. she was the daughter of the woman's boyfriend. it was poison that killed an illinois lottery winner. the medical examiner in chicago might exhume the body of a man whose death last july was ruled natural but a relative asked them to chec again. now it's considered homicide by cyanide. he died the day after he received $400,000 and it was cashed a month later with the money going to his estate. sharp minded sacramento woman talking about how she handled a home invasion intruder. she offered a man coffee who she found sleeping on her couch. >> that's when i unsheathed this machete and then i say,

after a couple of hours and scientists say that's precisely what we saw in that video. >> from across the bay to around the world, the stories that matter on "eyewitness news this morning." >> your realtime captioner: linda marie macdonald a san francisco bar pilot is in for a grilli good morning, everyone. it's tuesday, january 8. i'm michelle griego. >> hi, everyone. i'm frank mallicoat. 5:30 now. we begin with a san francisco bar pilot who is in for a big grilling by the coast guard later this morning. the big question, how did the ship he was controlling bump into the bay bridge? cbs 5 reporter cate caugiran is on treasure island in sight of the tanker that was damaged in the collision. good morning, cate. >> reporter: good morning, michelle. yes, that's the tough question he is going to have to answer in just a few hours. as you can see, that overseas reymar, that tanker is staying put behind me as coast guard continues its investigation which we're told could take a couple of days. now, today though they are

going to be looking for answers from the pilot in a few hours. the tanker was on the way to sea after unloading fuel cargo in martinez. and around 11:30 it hit a fender on the bridge. at the time the fog was thick visibilities a quarter mile. there was no significant damage aside from so many damage to the tanker's right side. >> there is not a gash in the hull whatsoever. there is i would characterize a crushing of the hull where it hit the fender. >> reporter: caltrans says there was no damage to the bay bridge. the tanker hit the fender and it acted like a bumper and took the brunt of the run-in. caltrans says they will replace 40 feet of it. now, as far as the pilot of the tanker, again, as we said he is scheduled for an interview with coast guard investigators. the "san jose mercury news" identifies him as guy kleess of san francisco. he ran aground a 550-foot cargo ship in sacramento years ago, that same year crashing a 600-

on the properties. here's the irony. both landlords face federal seizure of that properties because selling marijuana violates federal law. a judge has issued an arrest warrant for comedian katt williams. williams was a no show yesterday in a sacramento courtroom where he was to be arraigned on a felony charge of evading police. in this case from november he is accused of leading highway patrol officers on a chase through downtown sacramento. williams became a household name last year after a series of brushes with the law including one right here in oakland. he has had a tough six months. >> a very strange six months and he's a funny guy, too. not good to see that. >> you know who's funny? >> who? >> not lawrence! this morning. especially thick into the east bay valleys. visibilities there down to a quarter mile or less so be careful driving there. fog along the coast. temperatures not too bad this morning. 47 degrees in san francisco. high pressure holding on for one last day so looks like a milder day. yesterday we had numbers in the 50s and 60s. today probably a little warmer about 63 degrees in san jose, 58 san francisco. and should be about 60 degrees in livermore. some pretty nice weather around the bay area. that's the latest from here. how about a look at traffic with elizabeth? >> okay. thank you, lawrence. and outside right now, here's a live look at 880. this is near the oakland coliseum. it's actually close to the hegenberger exit. so northbound and southbound 880 are both moving fine between downtown and hayward. elsewhere we'll show you a couple more live traffic cameras one in the south bay

101 near trimble exit. in san jose we're not seeing any incidents at all. i want to get right to our maps because i was just following this problem on the chp reports. we're just getting word in the last cummins of a new accident westbound 80 approaching san pablo dam road. seems like outer lanes are blocked due to an overturned car. they are clearing it now. expect delays. we are not sure of the extent of joe robbie stadium. this just popped up on our chp reports so it's likely taking our sensors a little while to catch up. check out highway 4. it is slow in both directions even in the compute direction westbound and eastbound where there's some roadwork. i also put up that fog advisory. highway 4 between antioch and pittsburg. you may see it in the east bay valleys this morning, so heads up for fog. another foggy morning with low visibility. also, some areas of over into the roadwork until 6:00 this morning. southbound 101 between poplar and highway 92 in san mateo.

fewer firefighters. the nationwide standard forgetting to a fire is 6 minutes, 90% of the time. but the goal in san jose is 8 minutes in 80% of the time. in the past couple of years, san jose has laid off 50 firefighters and taken about half a dozen fire engines out of service. but reports indicated response times were not impacted. now it turns out a computer glitch was to blame for the false reports. san jose's response types are among the slowest in the country. >> we're looking to save lives and property. if we show numbers that -- or the numbers come out saying we are not achieving what we should be then we need some investment into this organization so that we can do better. >> and help is on the way. grants are paying to replace laid-off firefighters and 31 recruits are scheduled to graduate in the spring. coming up, a second inquest into the death of amy winehouse is released. >> plus, silent danger.

all caught on tape here. amateur video from salzburg shows one slide burying a road causing trees to go down like dominos there. elsewhere, rocks, mud partially buried a family home. several people have been evacuated, but so far no reports of any major injuries. but quite the mess to clean up there. >> yeah, looks like it. they shortchanged tons of homeowners, now america's biggest banks are going to pay. they are going to shell out $8.5 billion to settle a federal lawsuit over wrongful foreclosures. and jill schlesinger, editor at large for cbsmoneywatch.com is here with how much money hm will get. >> reporter: good morning. >> so how's this all going to work? >> reporter: there are basically two parts. banks are going to send checks totaling $3.3 billion to mortgage borrowers who were foreclosed upon in 2009 and 2010. now, look, there were almost 4 million of these folks not

everyone is going to get a check. so let me be clear about that. the second part of the deal, bangs are going to provide $5.2 billion of mortgage relief to current homeowners. that could mean lower rates or a reduction in outstanding principal for some folks. each of the participating banks is going to pay a different amount. the deal could get bigger. four large banks haven't signed off on this and two bank holding companies morgan stanley and goldman sachs. none of them have signed on. this deal could go to close to $11 billion according to some of the folks i spoke to. >> is this deal better for banks on consumers. >> reporter: you know, consumer advocates were going nutty yesterday. they said the cash payment part of this is only going to be a few hundred dollars. i want to really reiterate regulators who i spoke to said that amount is just the beginning part. it could rise to over $100,000 if your situation is deemed severe. it is a welcome relief to homeowners who have not been

able to qualify for a refinancing. but let me be also honest. this is a fantastic deal for the banks. the money is much less than the onerous process of hiring independent consultants and this really helps them put the mortgage settlements behind them. >> what should you do if you want to get in on the deal? >> so if you are an eligible borrower, you could receive again a range of compensation starting at a few hundred thousand dollars up to $125,000. again, depends on the error. the deal here is you don't have to file anything. a lot of people have filed requests for review of their foreclosures. you don't need to do that. you don't need to take further action. if you are one of the affected people, you will be contacted by a payment agent by the end of the march with details. and we have more information on this deal and how it affects you on moneywatch.com. >> okay, jill schlesinger, editor at large for cbsmoneywatch.com, thank you. a new york couple who lost their home in superstorm sandy has two problems with their

insurance company today. the first complaint from sheila and dominic trainor is about the payment they got for their home that was destroyed last november. allstate sent them $10,000. then the insurance company featured their home in an ad promoting its customer service in a neighborhood that president obama had toured. >> allstate used our house as a commercial that they have caring agents. well, how caring could they be? >> allstate says it has pulled the ad that featured the family's home and now they are trying to decide what to do with the $10,000 they got for their house. the consumer electronics show is expected to be the biggest yet. more than 3200 people are showing off the latest gadgets from more than 150 countries. cnet editor-at-large brian cooley is in las vegas with someone of the top tech trends of 2013. i think you're in heaven there,

brian. >> reporter: just a little bit! first of all, i'm sitting here at sony. i can't say it's their booth. it's their city of sorts. you can see over my shoulder one of the technologies very big here is a new kind of television that's called 4k tv. it's basically double the resolution of the best hdtv we have today. if you can imagine that! and when it has a 4k signal coming to it which is going to be very rare at first, it looks amazing. they say the television will be popular by the mid to late part of the year in terms of being the latest thing you will see in stores. >> very popular but also probably expensive? >> reporter: yeah. look at these to price above the best tvs we have today. so these will be, you know, several thousand dollars. could be $3,000, $4,000, $5,000, guessing on that on typical large sizes but they tend to come down. the tv industry was off a few percent for the first time in the history of the flat panel tv. >> and tvs are getting bigger.

[ laughter ] around the bay area today dense fog in the east bay valleys and advisory continues there. looks like that's going to break up leave lots of hazy sunshine by the afternoon. the temperatures up in the 50s and also the 60s so milder weather a little bit warner than yesterday. high pressure is in control but we have a lot of cold air developing in the gulf of alaska that's going to be diving in our direction tomorrow. but today, one more mild day outside. enjoy it. temperatures going to really cool off after that. still some patchy fog early on in the central valley and parts

of injuries but we can see it's going to back up into richmond and maybe beyond. we know that the outer lanes are blocked. fire crews have a couple of flatbeds out there as well so yeah, this is our problem spot down the eastshore freeway. it's in the commute direction. once you got past san pablo dam road then everything actually looks good through berkeley all the way towards the macarthur maze. but this is your drive time so far. i have watched this continue to pick up in the last few minutes. 24 minutes from the carquinez bridge to the maze. maybe a little bit longer than that in fact. and westbound 580 a few brake lights as well coming through the livermore area. also, this is where we have that fog advisory. chp issued this early this morning. stretches of highway 4 they say visibility is an issue now through antioch all the way towards the pittsburg-bay point area. you can see that really tight squeeze that bottleneck those speeds below 25 miles per hour just across those antioch exits. that's a check of traffic and weather together every 10
